These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FORTIS Technologies, LLC ("FORTIS," "Company," "we," "us," or "our"), a Texas limited liability company, governing your access to and use of the FORTIS construction management platform, including all associated mobile applications, web applications, application programming interfaces (APIs), and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, do not access or use the Service.
FORTIS provides a cloud-based construction management platform designed for general contractors, subcontractors, and construction professionals. The Service includes project management tools, expense tracking, document management, scheduling, communication features, and related functionality as described on our website and within the application.
FORTIS offers three subscription tiers, each available in Ad-Free and Ad-Supported variants:
Tier 1 — Field ($75/month | $59/month billed quarterly | $49/month billed annually): Designed for 1–2 users managing up to 3 projects. Includes daily logs, tasks, materials tracking, contacts, weekly PDF reports, and AI-assisted onboarding.
Tier 2 — Builder ($225/month | $179/month billed quarterly | $149/month billed annually): Designed for up to 5 users with unlimited projects. Includes full budget management, job costing, financial and cost breakdown reports, AI log assistant, and budget alerts.
Tier 3 — Pro ($375/month | $309/month billed quarterly | $249/month billed annually): Unlimited users. Includes everything in Builder plus change orders, Gantt scheduling, client and subcontractor portals, QuickBooks integration, invoicing, API key generator, and a full AI agent with conversational assistance, document Q&A, and forecasting.
Ad-Free Tiers provide the full Service experience without third-party advertisements. Ad-Supported Tiers provide the Service at a reduced subscription rate and include third-party advertisements and sponsored content within the application interface. The specific features, pricing, and advertising parameters for each tier are described on our pricing page and may be updated from time to time.
To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify FORTIS immediately of any unauthorized use of your account.
You must be at least 18 years of age to create an account and use the Service. The Service is designed for business use by construction professionals and is not directed at consumers under the age of 18.
You retain all ownership rights in the data you input into the Service. FORTIS does not claim ownership of your project data, documents, photographs, or other content.
By using the Service, you grant FORTIS a non-exclusive, worldwide, royalty-free license to use, process, store, and display your data solely for the purposes of providing the Service and as otherwise described in these Terms (including the creation of Anonymized and Aggregated Data as described in our Privacy Policy). This license terminates when you delete your account, except with respect to Anonymized and Aggregated Data that was created prior to account deletion.
All rights in the Service, including software, algorithms, user interface design, documentation, trademarks, and Anonymized and Aggregated Data products created by FORTIS, are and remain the exclusive property of FORTIS Technologies, LLC. Nothing in these Terms grants you any right to use FORTIS's intellectual property except as necessary to use the Service.
Subscription fees are billed in advance on a monthly, quarterly, or annual basis as selected by you at the time of subscription. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.
Quarterly subscriptions are billed every three months at a discounted rate (approximately 21% off the monthly rate). Annual subscriptions are billed once per year at a further discounted rate (approximately 34% off the monthly rate). The specific pricing for each tier and billing cycle is displayed on our pricing page and in the subscription selection interface.
FORTIS reserves the right to change subscription fees upon 30 days' written notice. Continued use of the Service after a price change constitutes acceptance of the new fees.
To the maximum extent permitted by applicable law, FORTIS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service or these Terms.
FORTIS's total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to FORTIS in the twelve (12) months preceding the event giving rise to the claim.
Nothing in this section shall limit FORTIS's liability for (a) fraud or intentional misconduct, (b) gross negligence in the handling of your personal data, or (c) any liability that cannot be limited under applicable law.
You agree to indemnify, defend, and hold harmless FORTIS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any data or content you submit to the Service that violates applicable law.
Before initiating any formal dispute resolution proceeding, you agree to contact FORTIS at legal@pro-fortis.com and attempt to resolve the dispute informally for at least 30 days.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Houston, Texas by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You and FORTIS agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Nothing in this Section 8 shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. Additionally, this Section does not limit your ability to file complaints with state attorneys general or the FTC regarding privacy violations.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions, except that applicable state privacy laws (including the CCPA/CPRA for California residents, the Colorado Privacy Act for Colorado residents, etc.) shall apply to the extent they provide additional rights to residents of those states as described in our Privacy Policy.
FORTIS reserves the right to modify these Terms at any time. We will provide notice of material changes by:
For material changes affecting data monetization practices, advertising practices, or privacy rights, FORTIS will provide at least 30 days' advance notice before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
If you do not agree with a material change, you may terminate your account before the change takes effect and request deletion of your Personal Data under our Privacy Policy.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and FORTIS regarding the Service and supersede all prior agreements, representations, and understandings.
